Terms and Conditions of Sale.
This English text is provided for information only. The contractual document is the French version, Conditions Générales de Vente. In the event of any discrepancy between the two, or of a dispute, only the French version is legally binding.
Identity of the provider
Purpose of the contract
These terms and conditions of sale apply to all services offered by Convives, Clarisse Dumas, including in particular:
- Preparation of meals at the client's home
- Catering services for private events
They apply to all clients, whether private individuals or businesses.
Prices and payment terms
- A detailed quote is drawn up for every booking. It states the total amount, the payment terms and any additional charges.
- Prices are stated in euros, inclusive of tax.
- A deposit of 30% is payable on signature of the quote to confirm the booking. The balance is payable within 15 days of the service.
- Accepted payment methods: bank transfer, cheque or cash.
- Any late payment will incur a surcharge of 1.5% per month.
Obligations of the parties
Obligations of the provider
- To deliver a service matching the description above.
- To comply with the food hygiene and safety standards in force.
- To inform the client of any major change to the service.
- To hold professional liability insurance covering the risks associated with the service.
Obligations of the client
- To provide a safe working environment suited to the needs of the service.
- To inform the provider of any dietary restriction or specific request at least 72 hours before the service.
- To pay the sums due in accordance with the agreed terms.
Cancellation and changes
By the client
Any cancellation must be notified in writing. Cancellation charges are as follows:
- More than 15 days before the service: 0% of the total amount.
- Between 14 and 7 days before the service: 30% of the total amount.
- Less than 7 days before the service: 100% of the total amount.
By the provider
In the event of force majeure (illness, accident, and so on), the provider undertakes to inform the client as soon as possible and to refund any sums already received, unless the client agrees to postpone the service.
Confidentiality
The provider undertakes not to disclose the client's personal or professional information, nor the details of the service, without the client's written consent.
Liability and insurance
- The provider is liable for damage caused by their fault or negligence.
- The client is liable for damage caused to the equipment or premises made available.
- Each party declares that it holds appropriate insurance cover.
Disputes
Any dispute relating to the performance of this contract shall be submitted to the courts having jurisdiction in the city of La Rochelle, France.
Acceptance
Signature of the quote constitutes full and unreserved acceptance of these terms and conditions of sale, in their French version.
